France: Doubts over ICJ decision are violation of international law

Putting into doubt the interpretation of the UN's court ,which voted pro-Kosovo on its legality of independence, means rejection of the International Court of Justice and violation of international law,  said the charge d'affaires of the Embassy of France in Belgrade, Michel Charbonnier.

The french diplomat, Michel Charbonnier, has stated that the new resolution Serbia has submitted to the General Assembly of the United Nations on Kosovo is unacceptable, and France was not consulted on this proposed document.

"This proposal which calls for negotiations on outstanding issues, namely the issue of independence, is a destructive maneuver, which aims to put doubt over the opinion of the International Court of Justice,” Charbonnier told Belgrade media.

He further stated that to France, the court's opinion is very clear, because the great majority of the judges found that none of the arguments against Kosovo independence is acceptable.

"Putting into doubt this interpretation means rejection of ICJ and violation of international law,”  said Michel Charbonnier of France.

Serbia put a request to UN General Assembly in 2008 asking it to back up its request of an opinion by the International Court of Justice on the legality of the declaration of independence by Kosovo. In an attempt to pacify the internal politics of Serbia and with the stated promise made by Serb leaders to let go of Kosovo if the ICJ case approved of independence, even some of the common friendly nations of both Serbia and Kosovo backed Serbia’s attempt. However, in the concluding months of the case, Serb officials stated publicly that they would not accept the opinion if it turned negative revealing the case as a sham, an obvious attempt to waste time and spread confusion among the community of UN member states.

While Republic of Kosovo is not yet a UN member and thus could not have been a party in a theoretical binding legal case between it and Serbia at the ICJ, Kosovo said it would respect the ICJ decision.

The new Serb resolution which will be put before the UN General Assembly this September covertly reinterprets the ICJ decision and calls for more talks on Kosovo status. This has led to calls for the resignation of Serb Foreign Minister by EU diplomats.
